Man charged after surf-rage attack at Lennox Head

A local surfer will appear in court next month accused of holding a woman's head underwater during an alleged surf-rage incident on the New South Wales north coast.

It is alleged the 55-year-old pushed the woman underwater three times after the man, riding a surf mat, and the woman's board collided at Lennox Head last month.

Detective Chief Inspector Cameron Lindsay said the man was charged this week with assault occasioning actual bodily harm. "We will allege that he held this female underwater to the point that she thought she was going to drown," he said.

"She was able to break free and get some air … we will also allege she faked being unconscious and was let go."

Police said they had heard of other surf-rage incidents at Lennox, and urged any witnesses to come forward.

"The message from police is to respect each other in the water, and the laws apply not only on land, but also in the surf," Chief Inspector Lindsay said.

Surf rage spreads as international visitors flock to breaks

The incident comes amid growing concerns about surf rage at the region's famous right-hand point break. A sign was recently erected urging visitors to "respect the locals, do not paddle up the inside".

Le-Ba (Lennox-Ballina) Boardriders Club president James Wood said heavy crowds had led to growing tension in the surf line-up.

"There's been a lot more people down here in the water, and it's starting to bubble over to incidents like that," he said. "It's hard to not be angry if a car full of people arrive and jump out and start taking every wave, and muscle in because they don't know the etiquette for the area."

"We probably educate them through yelling at them."

More peaceful in the water than it used to be

Local surf journalist Steve Shearer said a wave-starved winter had increased tension in the water. But the 48-year-old denied surf rage was getting worse as a result.

"To put things into context, when I was learning to surf and growing up, the surf culture was much more violent," he said. "If you stepped out of line there was more than likely going to be a violent consequence, and I think it's much more peaceful now.

"The crowding now, you've got to accept it, you've got to be prepared to get stoked on less."

I grew up in Ballina (left many years ago) and have seen the town and surrounds be destroyed by over development. I worked on one of the first houses in the headlands beach estate way down behind boulders. Now look at it. Ballina and Lennox are almost joined. Full of cashed up city folk who only see what they want. Everybody new everybody back in the day.If we surfed Lennox we respected the locals. We knew most of them through school and later work.If they surfed Ballina they showed respect to us. Thanks to progress and Ballina council, that part of oz is destroyed, just like port and Forster. The good old days are gone

Would be hard to prove the required intent for murder/attempted, but this kind of assault has serious jail time as a possible penalty. The fact he assaulted a woman shouldn't matter however it is hard to think a Magistrate or Judge will not take a much dimmer view of his actions for that reason.
The short answer is that this guy is fucked, the long one is that he's fucken' fucked.
Hopefully the result is harsh, gets a lot of publicity and sends a message to the surfers that behave in this manner.

You know what I get from this?

The main enforcer at Lennox rides a surfmat and bashes chicks.

I reckon you and evosurfer are completely missing the point here. Try and think about how women encounter the world and the ever-present threat of physical violence from men. Incidents like this say to women - the ocean is no safe place for you (just like land). HE NEARLY DROWNED HER. From my personal experience I've seen so many times men berate women in the surf even when other men have been doing the dropping in, they single out the woman to make an example. That's nothing other than an exercise by someone with more power wielding that over someone with less.
You're right though, this society is one sided. Men get paid way more than women. Men are the one that beat their female partners to death. Men are the ones who feel let down when the world they are promised (and then expect) isn't given to them.
I don't think society is saying we can't say a bad thing about women, I think society is just accepting that there are structural factors that make people encounter the world differently and we have to deal with that.

I see the beginner spots / nurseries where kids are trying to learn no being infiltrated by angry surfing mums and kooks on sups laying their own form of bullying/domination on the groms , go and paddle out at huzzas or inside grunters and take a look at the shitshow going on out there on a daily basis and what will the groms learn from this example? Been surfing in Bali lately? chaotic and fucking egomaniac horrible lord of the flies experience with surfers of both (or all to be politically correct) sexes being selfish greedy, rude ruthless cunts (some nationalities are worse than others but lets not add racism to my rant).
As for the story above a pro or ex pro,wannbe pro(male or female) dropping in and being a dick is an experience many of us have experienced, old mate really fucked up with his reaction and will face the wrath of both the law and the internet but hopefully both sides of the story are reflected as it unravels. I would love to see this footage if it exists.

Talking to a fellow who had seen the footage said.. the footage was very short. The wave had finished, they were a few metres apart in the white water. Forget who swam towards who. But i think she was giving him a mouthful and he just simply dunked her with his matt over the top. May have done it a couple times. The gent recording may have chuckled in shock at the odd scenes. Than someone walked in front of the camera and that was it. Well further grease the Chinese whispers wheel till we know more. Her hand was bandaged in the paper. Was either from her board, the lenno rocks or her smacking him. Dont think his mat could do that

In my experience women and girls in the line up generally get generosity and some leeway in the surf in normal day to day surf compared to a young male or a below average guy surfer. Once if it gets serious though (e.g. a mega day with heavy barrels or just the best day in ages at spot X) and the A team at whatever spot is pumping arrive AND waves are scarce, all generosity disappears for women, girls, groms, older surfers, beginners - anyone other than the small A team group.
So there are aggro weirdos here and there doing random stuff but women can get their share if they pick their days just as i have to.

If she jumped on the guys back, well that would be enough to flick the switch of a lot of the nut jobs lurking in the crowded line ups.

If ol mat rider can utilise a wave, then by dropping in, it is purely a fuck you moment. It appears it has been triggered by a collision (him attempting to take her board out more than likely, which is acceptable). Did she proceed to bomb him (not sure).
If it be the case she should lead by example for all surfers and have the charges dropped with an apology (Escalating a situation that should never have been presented, by dropping in). Ol mat could apologise for 2 extra dunkings and as a token of good will offer a custom mat to her.
Everyone wins.
Maybe there was a pre-cursor of which we may never know.

My smart mouth got me a dunking at BP, later returned the dropin at boiling pot. An unsaid common ground was found. But as someone said above. There are some stressed firecrackers around and it dont take much to ignite em.

EDIT. Looks like the beachgrit article highlights that ol mat dropped in. Well, I'll keep with status quo regarding dropping in, and accept my assumption on events was wrong.

My first reaction was gaol the bugger. I hate violence against women even if they are behaving outrageously. I hate seeing a blokes head being held underwater. Farking terrifying. Haven't seen that in years.

Disappointed to see some of the 'political correctness gone mad, you can't even hold a woman's head underwater these days' comments. Not the time to be arguing that line.

I'm competent in the water and was just having some lazy fun on a longboard one day and the guy goes full ballistic like a complete retard that I'd endangered his life/wellbeing. Gets intimidating and up in my face and then doesn't let it go completely spoiling his own session. Just seemed like a bitter, angry old cunt. You're surfing The Pass for fucks sake - sorry it's changed and you don't have the good old days but if you're going to act like that maybe it's time to just move on and surf elsewhere ...

Yeah mate I've no doubt his behaviour was irrational, I've seen it many times before from him. And like you said - why doesn't he just move on. Easier said than done. The long term surfing community in Byron has always been a low income subsistence lifestyle. The reality of living there now is so expensive that any meagre reserves of income are used in just surviving. I know firsthand - I've just left after 24 years there but am fortunate to have the resources and opportunity to reestablish myself further down the coast. Steve has watched his lifestyle choice disappear, living week to week trying to hang on to it. He can't afford to operate on his knee so he's lost his ability to do what he loves. In the near future the house he has rented forever is going to be knocked down and redeveloped. He's lost his community, his ability to surf and soon a place to live. Pretty daunting times for someone his age with limited mobility and resources.
These aren't excuses for his behaviour, merely contributing factors to it.
And I think as an overall recurring theme which is prevalent through this entire thread, is that even though we're all surfers, all chasing the same wave, the same feeling - we're all also completely different. We all bring the baggage of our entire lives into the ocean, many of us use surfing as a therapy, some of us just enjoyment, some of us it's a virtual addiction. At that moment of attaining the feeling we are searching for, if someone interferes with that and the outcome we are expecting, then a life's emotions can come pouring out.
Just some random thoughts to consider. I hope you're finding some uncrowded waves somewhere...

Now that Brodie Carr (the ex CEO of WSL and soon to be the most hated surfer in WA) is the new CEO of tourism WA I would be fucking worried, Kalbarri on the cards for sure 2020 and Margs delegated to QS which will still bring too much exposure and a heap of wanna be pro surfers to town (with a shorter time window rather than the usual 5 week takeover of the point being the only possible silver lining).

A healthier Buddhist attitude/outlook has got to prevail in dealing with and mitigating generally against more anti-social localism and aggression; yes, alright, some of you will scoff and say "Oh, fuck that" - but face the fact that any half reasonable surf breaks are only going to get considerably more crowded and tense in future.

I just read that a teachers aid (female) received no jail time for having sex with 5 of her students at an Armidale boys school. The boys were 15 to 18 years old.
Imagine if the situation was that it was a male teachers aid entertaining five girls that were students of his.
The scenario would have played out very differently in court I think.

As I said, I don't know what happened, but from the comments, she may have jumped on him, or even thrown a punch. If this is true and if she initiated the fight it is an aggressive assault and he should be legally justified in protecting himself in ANY way a judge or jury can be convinced is reasonable in the circumstances.

I'm not taking sides....they both probably contributed to what happened.....but I also don't think gender, in any degree, should decide guilt.

This question is related to this article in theory but not specifically about the incident at lennox:

before i start, totally against violence in the surf and everywhere else in general. only instance where i would strike out is if i was defending myself or my family.

Just like everywhere else, there are more than a few famous fuckwit surfers around my area. Females are fairly represented in this group. Now i have no problem whatsoever having a word (not violence) with people if they are doing it maliciously but i've never pulled up any of the girls, i just don't feel comfortable doing it, not the way i was brought up. I only rarely see anyone saying anything to them and have always had a theory that because they are never being pulled up for their bad behaviour, it is compounding the problem by normalising it. So where is the line? If you are being mugged by a woman, can you punch her in the head as hard as you can? I'm totally against violence in the surf no matter who you are but this type of incident is going to pop up more frequently now with crowding and am genuinely interested in some opinions on the smartest way forward.

My experience surfing Lennox when it's good is that the women's place in the lineup is often ignored and they have to fight harder for their waves.

This obviously doesn't translate to all people ignoring them and to all spots on the coast.

Naming the alleged offender is not the point, and I think you'll find the professional media organisations never open up forums when people have been charged and are awaiting trials. It's all about not interfering with the court process.
The "Comments below the fold are (NOT) incidental." It's trial by social media and that creates mayhem for the judicial system, prosecutors and police trying to do their jobs. It's also fantastic for defence barristers. But hey, you guys know better than media organisations with teams of lawyers advising what can, and what can't, be published.

Here's a little light reading for you. I suggest you get a second opinion on your legal advice.

The five main areas where journalists are likely to run the risk of committing contempt are:

1. Publishing matter likely to prejudice a fair trial

From the time somebody is arrested, charged or a warrant is issued, up to the moment when the court finishes dealing with it, the case is said to be sub judice. This is a Latin phrase meaning "under judgment". While a case is sub judice, you are strictly limited as to what you can report.

You may only give details of what is happening officially within the legal process. In practice this means only information which is part of a charge or details which are part of actual court proceedings. You may also mention some details which are not likely to be contested in court.

Several kinds of reports while a case is sub judice may prejudice a fair trial. One has already been mentioned - publishing details of the defendant's previous convictions.

Another is broadcasting details of the background of the case. Whenever there is a big trial, reporters gather together details of the defendant's past life and other background information, ready to publish them at the end of the trial. Once the trial is over, and is no longer sub judice, then all this material can be reported. However, if any of it is published during the trial it may be held to prejudice a fair trial.

If there is no jury, then what is published or broadcast is not so likely to prejudice a fair trial, since the judge will be more able to ignore it. Nevertheless, even in trials without juries there are limits to what will be tolerated and care should be taken not to interfere with the proper course of justice.

Can't quite believe I'm getting into this....but *deep breath*....we've run an ABC article with no names mentioned. Since then many other publications have run the story with names of both parties and much more besides. The defendants name doesn't appear in our comments. The comments have taken the usual trajectory for a story of this nature, lots of unrelated anecdotes, lots of unfounded speculation. In other words, nothing out of the ordinary. Social media is not 'reporting' and it's taken into account in these matters - i.e the public can, and indeed will, have their opinions.

None of what you've posted applies to us.

Go find something else to whinge about. I'm sure you can find plenty.

Your commenters are publishing highly prejudicial information about the alleged perpetrator and the alleged incident. It's no doubt being read by thousands of people in the area where the alleged crime was committed. Any lawyer worth half his salary would copy this page and use it in the defence. Well done Swellnet. Trial by social media does have consequences.

Jesus H, mate. I can point you to at least five Facebook threads that have garnered more comments, that name the perpertrator, and where real people are using their names (not online handles) to make threats of violence against him.

There are also the mainstream news sites that have named him, and their concomitant social media posts, plus a collection of surf sites also naming him, and their comments too.

Meanwhile, the only people that are named on this page are Johnny Boy Gomes, Steve the gut slider at the Pass who yells at people, and Brodie Carr for some reason. The defendant's particulars just ain't here.

How many other incidents of surf rage at Lennox Head, involving an airmat dude and a former female pro surfer, will be going to trial over the next few months? I think legal folks will be able to work out exactly who this post is about. There's no confusion. Your commenters have brought up his alleged criminal past and are openly commenting about the incident and potential evidence before it goes to court.
The legal and practical differences between random facebook posts and actually hosting a discussion on the alleged assault are massive.
Pointing to other people potentially prejudicing an upcoming trial doesn't mean you haven't done exactly the same.

Hello, I just felt that it should be pointed out that this case will not be determined by a jury. Most of the contempt of court type situations arise where there is publication of information that the jury would not ordinarily hear, such as the defendant's criminal record. The case referred to above (in the link to the article) was a murder case where the trial miscarried as a result of the information published - its a totally different situation.
Whilst I'm here - the s.10 with a bond prediction is probably valid - there are many variables obviously - but the fact a Future Can was used versus arrest and bail is not really relevant to how the court will ultimately determine the case.

Ive heard that in some jurisdictions if a male reports abuse by a female the police are instructed to proceed on the assumption it is actually him that has committed the assault.

My one and only surf at Lennox was in July when I had it completely to myself for an hour. Rather surreal. I thought maybe there'd been a shark sighted, but I think it was just dumb luck. In the end a dude on a mat paddles out. It wasn't the guy in question here. This bloke was super friendly and was more than happy to answer my queries regarding surf-mats. I don't think I'll ever bother surfing the place again, since I'd like to keep that memory of having it to myself untarnished.

There certainly is some misinformation out there regarding eggs. Eggs are a nutrient dense whole food and a great source of protein. While they are avoided with a confirmed egg allergy diagnosis and intake limited for people with cardiovascular disease (6/wk), for everyone else they can be an everyday food.

Maybe it took that long to track down the person with the video or a witness? If you're not a local it could be difficult to find a witness prepared provide evidence or to know who took the video. Without a witness or video I imagine it would be hard to substantiate that an assault actually occurred.

udo without knowledge of the specifics of this incident, it behoves me to call a point of order regarding the whole "why wouldst thou delay reporting such a terrible infringement upon one's person?" rhetoric.

There are several factors at play. You say 'crime' like it is obvious that a line has been crossed however the general public are often clueless as to where courts draw these lines. eg Can you offer an explanation of the difference between 'Assault' and 'Aggravated Assault'?

Added to this are many layers of patriarchy which have time and again shown women that to speak up is to put yourself in the public stocks subject to ridicule and public shaming at a minimum with the added bonus of death and rape threats against you and anyone you friended on Facebook twenty years ago.

Not to mention the personal trauma at the heart of such an experience, it takes time for a person to process these things. "Did I deserve it? Did I do something wrong? Could I have fought back? If I had zigged instead of zagged at just the right moment maybe it would have been me choking him?" etc

Which leads to the obvious question, would you report this 'crime' if you were on the receiving end, udo?
